TERMS AND CONDITIONS
This document sets out the terms and conditions between Turing Festival Limited and you when you purchase a ticket or register for any event or conference organised by Turing Festival Limited, or participate in any survey of Turing Festival Limited’s. By purchasing a ticket or registering for an event or conference organised by Turing Festival Limited or participating in a survey you are agreeing to comply with and be bound by these terms and conditions. You should read this document carefully.
Turing Festival Limited reserves the right to change these terms and conditions at any time. Any amended terms and conditions will be posted to this website. This updated version of terms and conditions for Turing Festival Limited is applicable from 16 November 2018.
The Scottish Tech Startup Awards 2018 is being organised by Turing Festival Limited, a Scottish company, SC533170, which is in the main business of organising technology conferences and gatherings including, but not exclusively, under the brand names Turing Festival, Turing Fest, NextGen, Startup Dinners, and Scottish Tech Startup Awards.
References to “us” means Turing Festival Limited and references to “we” and “our” shall be construed accordingly. References to “you” means the entity completing the booking request and attendees and references to “your” shall be construed accordingly.
DECLARATION OF CONSENT
You hereby give your consent for Turing Festival Limited (and its subsidiaries and affiliates) to collect, process and use your personal data for the purposes of processing the purchase of your ticket and for any other use to which you have consented, including importation of contact information for which you have provided your explicit prior consent.
This information will be used for the purposes of processing ticket sales and compiling delegate lists which may be published on our websites and across any relevant online portals, websites or platforms, and circulated by email to our email database, which includes all past and current delegates. If you do not wish your name, photograph, country where based, job title and company name to appear on the delegate list please email email@example.com.
1. PURCHASING TICKETS

2. ONLINE SURVEYS
You hereby give your consent for Turing Festival Limited to store any voluntary information you may provide in the course of participating in an online survey. You acknowledge and accept that your data will be used for commercial purposes in accordance with these Terms and Conditions and Declaration of Consent and will be retained and stored for this purpose.

The cost of replacing a lost or damaged wristband is £50 excluding VAT.
All rights in all presentations, documentation and materials published or otherwise made available as part of the conference (including but not limited to any documentation packs or audio-visual recording of the conference) (“Content”) are owned by Turing Festival Limited or are included with the permission of the owner of the rights. You shall not distribute, reproduce, modify, store, transfer or in any other way use any of the Content for commercial reasons or in any way that might infringe third party rights or that may bring us or any of our affiliates, partners, or speakers into disrepute.
We actively encourage tweeting, blogging, and sharing photos and videos of the event.
The Content does not necessarily reflect the views or opinions of Turing Festival Limited.
Whilst we take care to ensure that the Content created by us is accurate and complete, much of it is supplied by third parties and we are unable to check its accuracy or completeness. You should verify the accuracy of any information (whether supplied by us or by third parties) before relying on it. The Content is provided on an “as is” basis without any warranties of any kind (express or implied). We hereby exclude to the fullest extent permitted by law all liabilities, costs, claims, damages, losses and/or expenses arising from any inaccuracy or omission in the Content or arising from any infringing, defamatory, or otherwise unlawful material in the Content.
To the extent that any Content is made available by us online, we reserve the right to suspend or remove access to such Content at any time.
We reserve the right to change speakers at any time without recourse.
Ticket prices will be clearly marked on the ticketing site. Turing Festival Limited will only offer payment by invoice for 5 tickets or more due to administrative overhead involved. If you are paying by invoice, payment is due within 14 days of invoicing. Ticket prices will only be honored for the 14 day period stated on the invoice. After that period, ticket prices will increase to the price clearly marked on the ticketing site, if that price is higher than the invoiced price. Tickets will only be issued upon full payment, and are subject to availability.
You cannot resell a ticket. This includes tickets purchased at any price point, or allocated through a sponsorship. Doing so will void the ticket and neither the ticket’s original purchaser or the subsequent ticket holder will gain entry to the event.
All tickets must be assigned to an attendee, and all attendee details must be 100% complete within 30 days of receipt of your ticket. This includes name, job title, company name, and email.
Ticket reassignment is allowed until 7 days before the conference or event. Reassignment after this date is prohibited.
In certain cases, free or subsidised tickets may be offered within 30 days of the event start date. In these instances, tickets must be assigned within 7 days of receipt of your ticket in accordance with the details provided in the above paragraph.
If you have secured a free or subsidised ticket but have already bought a ticket, you are not eligible for a refund.
7. EVENT INFORMATION
You acknowledge that Turing Festival Limited will not provide transport or travel expenses to or from any event or conference.
Turing Festival Limited endeavors to make its conferences and events accessible to all. If you have special access requirements (such as wheelchair access) please contact us when you register so we work with the venue to best accommodate you.
By agreeing to act as a volunteer at an event, you acknowledge that:
You will receive no compensation for travel, accommodation, etc.
There is no guarantee that you will be selected to be a volunteer at the event.
If you violate any event rule or fail to show up for an assigned shift, your accreditation can be removed and you will be denied access to the event.
You attest to the truth of all statements made in your application.
The use of alcohol and/or controlled substances before or while on duty is strictly prohibited. Violation of this policy will result in immediate dismissal, removal of accreditation, and removal from the event grounds.
Selection as a volunteer grants permission to Turing Festival Limited, or other group companies, to use the volunteer likeness, name, voice and words in television, radio, film, newspapers, magazines, and other media, but during and anytime after the event, and in any form, for advertising or communicating the purpose of the event(s).
In the course of the event, you may be dealing with confidential information and you agree to keep such information in the strictest of confidence.
You have read and fully understood these terms and conditions.
10. USE OF PERSONAL DATA FOR ADVERTISING PURPOSES
Mandatory and voluntary data collected when purchasing tickets.
Mandatory and voluntary data collected when registering a complimentary admission ticket as well as the date of the ticket registration.
Voluntary disclosures when participating in online surveys.
If you have opted-in to receive email communication about related events you give consent for Turing Festival Limited, subsidiary companies, and partners to analyse and use the data for the purpose of targeted advertising communications to you on relevant topics and products in connection with Turing Festival Limited or subsidiary events and promotions.
Data collected from any connected social media for which you have provided your explicit prior consent.
If you have provided your mobile telephone number you consent to Turing Festival Limited or subsidiary companies and partners to contact you by SMS in relation to events for which you are purchasing a ticket or registering an expression of interest.
You acknowledge that and consent to your data being used for marketing purposes by Turing Festival Limited or a third party to contact you by phone or e-mail to ascertain your views on Turing Festival Limited services, which will be similar to the ones to which you have already subscribed.
You furthermore consent to the mathematical and statistical analysis of your personal data for advertising purposes (scoring). However, your e-mail address may be used for advertising purposes only with your express consent.
You also give you consent for your data to be updated and supplemented with additional data.
Accordingly, you give your consent for Turing Festival Limited (and subsidiaries and partners) to collect data relating to you personally from public domain sources and to store these along with your personal data that are already under the control of Turing Festival Limited (and subsidiaries and partners). you give your consent for Turing Festival Limited (and subsidiaries and partners) to analyse this newly collected data together with the data already under their control and to use the same for the purpose of targeted advertising communications to you on relevant topics and products in connection with trade fairs and/or exhibitors of interest.
Turing Festival Limited has free lifetime use of any image of video content created by attendees at Turing Fest, Scottish Tech Startup Awards, and any other events organised by Turing Festival Limited.
You give your consent for Turing Festival Limited to publicly announce our business relationship with me and your company which shall include but shall not be limited to announcements on social media. Such announcements shall not be disparaging or otherwise adverse to your business.
When personal information (e.g. name, email address, work address, phone numbers and other contact information) is provided through the Turing Festival Limited website or directly to Turing Festival Limited by email you give consent to Turing Festival Limited for:
Processing and administering your personal data to perform all necessary actions to give effect to your request or instructions
Retaining a record of incoming and outgoing communications (e.g. email) to process your personal data as outlined in these Terms and Conditions.
Turing Festival Limited may also collect the following information about you:
Information that you provide by filling in forms on our site.
Name and physical shipping, contact and payment addresses.
Email address and telephone numbers
Credit card, debit card or bank information.
Date of birth
Tax identification or VAT number (if applicable)
Social Media profiles, e.g. Facebook, Twitter, Linkedin
If you contact Turing Festival Limited, Turing Festival Limited may keep a record of that correspondence.
Information Turing Festival Limited receives from credit reference and fraud detection agencies or other third parties may be used to verify your information.
Turing Festival Limited may ask you to complete surveys for research purposes, although you do not have to respond to them.
Turing Festival Limited may collect and store your personal preferences related to events and information that you share with your prior consent via third parties such as Facebook correspondence, testimonials, photos, blogs, writings, customer satisfaction surveys or customer service communications that you may send.
Occasionally, Turing Festival Limited works with hotel partners and conference planning partners to offer discounted room rates to conference attendees. It is a standard practice in the conference planning industry to share lists of conference attendees (names only) with hotel and conference planning partners in order to audit the reservations at hotels and to ensure that all attendees with a hotel registration are identified as conference attendees.
You hereby consent for Turing Festival Limited to share your name only (no company information or contact information) with our hotel partners and conference planning partners for the purposes of hotel reservation auditing.
RIGHT OF ACCESS
You have a right to be given a copy of any of your personal data held by Turing Festival Limited in accordance with section 4 of the Data Protection Acts subject to certain exceptions. Requests for a copy of your personal data can be emailed to email@example.com or addressed to:

RIGHT OF RECTIFICATION OR ERASURE
If Turing Festival Limited holds incorrect information about you which was originally submitted by you through this website, you have the right to have the data amended. Further, you have the right to have any information you have sent to us via this website erased. Please note that Turing Festival Limited is not required to rectify or erase your data where doing so would prevent you from meeting your contractual obligations to Turing Festival Limited or where Turing Festival Limited is required to process (including retaining) your personal data for a lawful purpose in accordance with the Data Protection Acts. In the event of any conflict between these terms and the provisions of the Data Protection Acts, the Data Protection Acts shall prevail.
The security of your Personal Information is important to us. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, Turing Festival Limited cannot guarantee its absolute security and cannot accept any liability where the security of your Personal Information is compromised. When you enter sensitive information (such as credit card number) on our registration or order forms, we use third party payment processors who encrypt that information using secure socket layer technology (TLS/SSL).
CHANGES TO THIS POLICY
Turing Festival Limited reserves the right to modify these Terms and Conditions and Declaration of Consent at any time. Any changes will be posted on our homepage and other places we deem appropriate so that you are aware of the changes.
11. REFUND AND CANCELLATION POLICY
All purchases of tickets for conferences and events are non-refundable in their entirety. Your ticket remains the property of Turing Festival Limited and is a personal revocable license, which may be withdrawn, and admission refused at any time upon a refund of the printed registration price.
In the unlikely event of cancellation of a conference or event, the liability of Turing Festival Limited is limited to the share of paid registration fees that remains after credit card and payment processing fees have been incurred and deducted.
It is strictly forbidden for any company, organisation or attendee to attempt to host or organise any event in conjunction with, contiguous to or purporting to be related to Turing Fest, or any of its other events, or its affiliates without the express prior permission and cooperation of Turing Festival Limited. In the event of breach of these terms any tickets purchased by the organiser and their affiliates will be rendered null and void. Turing Festival Limited reserves their right to take such legal action including a claim for damages as may be appropriate.
The tickets purchased are non-transferrable; they are for your own personal use or that of your business only and may not be resold or transferred under any circumstances, including but not limited to use as part of any promotion or competition. Where there has been any resale or attempted resale of any tickets (or any other breach of this term), Turing Festival Limited reserves the right to cancel the relevant tickets with immediate effect. Single day tickets are only valid for the day for which they were purchased. Multi-day tickets are non-transferrable, and cannot be shared by different people over different days of the event.
We reserve the right to cancel any ticket purchase made by any person or body whom we reasonably believe to be associated with any ticket broker or tout.
Turing Festival Limited reserves the right to refuse or revoke admission to any event or conference for any behaviour, which it deems unacceptable, or for breach of these Terms and Conditions, or for breach of our Code of Conduct.
Turing Festival Limited and its subsidiaries will not be responsible for any tickets that are lost or stolen. The unauthorised use of photographic and recording equipment at events and conferences is prohibited. You consent to film and sound recording as attendees at any event or conference.
Turing Festival Limited and its subsidiaries will not be liable for any loss injury or damage to any person or property howsoever caused (save for death or personal injury as a result of Turing Festival Limited’s negligence or for any other type of liability that cannot by law be excluded or limited.)
Turing Festival Limited will not be liable for the granting of any visas that are required to attend any event or conference. In the event that an attendee’s visa is not granted tickets will not be refunded for any event or conference. Turing Festival Limited will not issue letters of invitation for visa application purposes.
Reassignment of tickets will be permitted via the website free of charge up to 7 days prior to the commencement of the event. No name changes will be allowed after 7 days prior to the commencement of the event and the ticket price will be forfeited.

In the event that the purchaser is a consumer and to whom the European Directive on Consumer Rights (Directive 2011/83/EU) applies, the consumer would be entitled to a cooling off period of fourteen days which would begin on the day the contract for distance selling was concluded.
If you have been selected to volunteer at the event but have already bought a ticket, you are not eligible for a refund.
Complaints can be made to firstname.lastname@example.org. We will endeavour to resolve any customer complaints where reasonable.
13. EVENT CANCELLATION, POSTPONEMENT & SUBSTITUTION POLICY
Turing Festival Limited is not responsible for any loss or damage as a result of a substitution, alteration, cancellation or postponement of an event. Turing Festival Limited shall assume no liability whatsoever in the circumstances that an event is cancelled, rescheduled or postponed due to a fortuitous event, Act of God, unforeseen occurrence or any other event that renders performance of an event impracticable, illegal or impossible. For purposes of this clause, a fortuitous event shall include, but not be limited to: war, fire, labour strike, extreme weather, terrorist threats or other emergency.
Please note that while speakers, topics, and entertainment are confirmed at the time of publishing, circumstances beyond the control of the organisers may necessitate substitutions, alterations or cancellations of the speakers and/or topics and/or entertainment. As such, Turing Festival Limited reserves the right to alter or modify the advertised speakers, topics, and/or entertainment if necessary without any liability to you whatsoever. Any substitutions or alterations will be updated on our web page as soon as possible.
14. TICKET DELIVERY
Once a successful purchase transaction has been completed, tickets are delivered in electronic soft-copy via email to the email address nominated by the purchaser. For some ticket types it may be necessary to complete required information — such as attendee name — before the tickets can be issued. The ticket acts as a receipt for the transaction and can be used to redeem entry at the event listed on the ticket. A printed hard-copy ticket or an electronic soft-copy ticket detailing the reference number can be used to register at the event. Scots law governs these terms and conditions and any dispute are subject to the exclusive jurisdiction of the Scottish Courts.
15. GENERAL CLAUSES
a. Turing Festival Limited shall be entitled to delegate the duties provision of its obligations under this Terms and Conditions.
b. No other terms shall apply to this Terms and Conditions and this document contain the entire terms and conditions and understanding between us in respect of all matters which are referred to herein and supersede any prior, written or oral agreement between us relating to such matters. You confirm that in agreeing to accept these terms you have not relied on any representation that is not expressly included herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become a part of these terms. However, nothing in these terms purport to exclude liability for any fraudulent statement or act.
c. If any part of the terms herein shall be deemed unlawful, void or for any reason unenforceable then that provision shall be deemed to be severable from these terms and shall not affect the validity and enforceability of any of the remaining provisions of the terms.
You agree not to:
Use the website (or any part of it) for any illegal purpose and agree to use it in accordance with all relevant laws;
Upload or transmit through the Website any computer viruses, macro viruses, trojan horses, worms or anything else;
Use the Website in a manner which (i) may cause the Website to be interrupted, damaged, rendered less efficient or such designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or (ii) any material which is defamatory, offensive, or of an obscene or menacing character, or that may cause annoyance, inconvenience or needless anxiety; (iii) that the effectiveness or functionality of the Website is in any way impaired or (iv) violates or infringes the rights of any person, firm or company (including, but not limited to, rights of intellectual property, rights of confidentiality or rights of privacy) of the website;
Create or publish a hypertext link to any part of the website or attempt any unauthorised access to any part or component;
Copy or distribute any part of the website in any medium without the prior written consent of Turing Festival Limited; and
Alter or modify any part of the website other than as may be reasonably necessary to use the website for its intended use.
Turing Festival Limited reserves the right to:
Modify or withdraw, temporarily or permanently, the website (or any part of it) with or without notice to you.
Change these Terms from time to time. Your continued use of the website (or any part of it) following such change shall be subject to and including the changes made to the terms from time to time.
Monitor any activity and content associated with the website.
We may investigate any reported violation of these Terms and Conditions to confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website; and/or deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed. If you do not agree to any change to the Terms and Conditions then you must immediately stop using the website. We may investigate any complaints relating to the website and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the website).
16. LIMITATION OF LIABILITY
Our aggregate liability to you, whether such liability arises in contract, tort (including negligence) or otherwise, for any damages, loss, costs, claims or expenses of any kind howsoever arising, out of in connection with any booking (or requested booking) made by you or otherwise in relation to a conference or event, shall be limited to the price paid by you in respect for your booking to attend the conference.
We shall not be liable to you for (i) any loss of profit, loss of or damage to data, loss of anticipated savings or interest, loss of or damage to reputation or goodwill or (ii) any indirect, special or consequential damages, loss, costs, claims or expenses of any kind.
You agree to indemnify us, our staff and our affiliates and to hold us harmless to the fullest extent permitted by law, against all loss, costs, claims or expenses of any kind arising from any act or omission by you (including your delegates) during or otherwise in relation to a conference.
Nothing in these Terms and Conditions shall limit or exclude either party’s liability for death or personal injury caused by that party’s negligence, or the negligence of that party’s employees, agents, or subcontractors; fraud or fraudulent misrepresentation; or any other liability which cannot be limited or excluded by applicable law.
You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of these terms and conditions by you or any other liabilities incurred by us arising out of your use of the website, or use by any other person accessing the website using your computer or internet access account.
18. INTELLECTUAL PROPERTY AND RIGHT TO USE
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content contained within the website shall remain at all times owned by us or as stated in Clause 5. You are permitted to use this material only as expressly authorised by us.
We reserve all rights not expressly granted in and to the website and the Content in the website.
